1. Information on how to enter and prizes for the “2020 Graduation Competition” (“Competition”) form part of these Terms (“Terms”). Entry into the Competition is deemed acceptance of these Terms.

COMPETITION DETAILS

  1. The Promoter of the Competition is Australian Catholic University Limited, 40 Edward St, North Sydney NSW 2060 Australia. ABN 15 050 192 660.
  2. The Competition commences 9.00am AEST on 18 November 2020. Entries close 11.59pm AEST on 28 November 2020 (“Promotional Period”).
  3. The Competition is a game of skill. Chance plays no part in determining the winners.
  4. Entry is only open to all students of the Promoter graduating in 2020.
  5. The Promoter reserves the right to verify the validity of entries and reserves the right to disqualify an entrant for tampering with the entry process or for submitting an entry, which is not in accordance with these Terms.
  6. Entries are to be submitted through Facebook or Instagram. You must have an account associated with one or both of these services, and your entry must abide by these services’ respective terms and conditions at the time of posting.

ENTERING THE COMPETITION

  1. To enter, entrants must, during the Promotional Period:
    1. Upload a photo of their 2020 graduation celebration. The graduate entering the competition must be visible in the photo and
    2. Post the photo to either of the following:
      1. The ACU Graduation 2020 Facebook page (https://www.facebook.com/groups/acugraduation2020); and/or
      2. Instagram, using one of the following tags #ACUGrad2020 or #ACUlater.
  2. Entries must not promote violence, racism, sexism, fascism and other derogatory or discriminatory views. Entries must not be defamatory or offensive to any individual. Entries must not showcase the consumption of drugs or smoking. Entries must not portray any sexual images, intercourse and/or nudity.
  3. The Promotor retains the right to exclusively determine and disqualify entries that do not adhere to clause 9 above, without notification to the entrant. The Promotor will not enter into correspondence regarding disqualified entries.   
  4. Each entry must be original and all entrants agree that their entries do not contain any material that infringes the rights of anyone else.
  5. Each entrant may submit multiple entries, however individual entrants cannot win multiple prizes.
  6. Entries not completed in accordance with these Terms or received after the closing date will be considered invalid and will not be included in the Competition.

ENTRANTS OBLIGATIONS

  1. Entrants guarantee and warrant that:
    1. all details provided with your Entry are true and accurate;
    2. your Entry is wholly comprised of original work, created and owned by you.
    3. you have all necessary rights and licenses to grant the rights set out in these Terms and will produce evidence of any such rights or licenses at the Promoter's request;
    4. the exercise of the rights granted to the Promoter in these Terms will not infringe the rights of any third parties; and
  2. Entrants undertake to indemnify the Promoter against all claims, demands, losses and damages that the Promoter incurs as a result of a breach by the entrant of its obligations under these Terms and the Promotors use or publication of their entry.
  3. All entries become the property of the Promotor upon submission.
  4. Each entrant grants to the Promoter the perpetual right to reproduce, publish, transmit or otherwise communicate to the public their entry, in whole or part, in or using any media for any purpose without permission or payment.

PRIZES AND JUDGING

  1. The winners will be selected by the Academic Registrar (the Judge).
  2. At her sole discretion, the judge will select the six Entries that best meet the following criteria of Authenticity, Emotion, Creativity and Composition. Each criteria will be judged on a point system worth 25 points, and are explained below:
    1. Authenticity: Acceptable manipulation includes correction of red-eye, cropping, and straightening of photos. No added text, colour manipulations, filters or photoshopped submissions.
    2. Emotion: Compelling images evoke laughter, pride, and wonder. The initial impact should evoke a sense of celebration.
    3. Creativity: The original, fresh, and external expression of the imagination of the maker by using the medium to convey an idea, message or thought.
    4. Composition: Important to the design of an image, bringing all of the visual elements together in concert to express the purpose of the image. Proper composition holds the viewer in the image and prompts the viewer to look where the creator intends.
  3. The winners will be chosen at ACU’s North Sydney Campus, Australia on Monday 30 November 2020.
  4. Winners will be announced on the ACU Graduation 2020 competition Facebook page the ACU and where possible notified via direct message to their Facebook or Instagram account by 8pm on Wednesday 2 December 2020.
  5. The judge’s decision is final and no correspondence, including in the event of a dispute, will be entered into.
  6. Each of the six winners of this Competition will win one the following prizes:
    1. Full academic regalia and a graduation bear; or
    2. A graduation commemorative plaque and a graduation bear. (the Prizes).
      The winners may choose Prize a or Prize b above. Winners are not entitled to two prizes.
  7. The total individual prize value is up to $425.  
  8. The total prize pool is valued at up to $2250.
  9. The Prize values are correct at time of printing but no responsibility is accepted for any variation in the value of any Prize. Prizes supplied by a third party are subject to availability. In the event that any prize is unavailable for whatever reason, the Promoter reserves the right to substitute any prize for a prize of equal or greater value.
  10. Prizes are not transferable, exchangeable or redeemable for cash and non-monetary components cannot be taken as a monetary payment.
  11. Any tax liability arising as a result of accepting any prize is the responsibility of the winner. If a winner as not been in contact with the Promotor to claim its Prize within 5 days of a notification email, the Promoter reserves the right to offer the Prize to the next eligible entrant. The Promoter does not accept any responsibility if an entrant is not able (or otherwise fail) to take up the Prize. In that event, the new winner will be selected in accordance with these Terms.

LIMITATION OF LIABILITY

  1. To the full extent permitted by law (which does not affect your statutory rights), the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate you or accept any liability for:
    1. any incorrect or inaccurate information;
    2. any technical error that may occur in the course of the administration of this Competition;
    3. any error, omission, interruption, deletion, defect, loss or delay of any Entry or otherwise in operation or transmission, communications line failure, technical malfunction, theft or destruction or unauthorised access to or alteration of your Entry or the running of the Competition; or
    4. any injury, damages, expenses, or loss whatsoever (whether direct or consequential) to you or your property as a result of any person entering into the Competition or accepting or using any Prize, including without limitation non-receipt or damage to any Prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees.

DATA PROTECTION AND PRIVACY

  1. The Promoter collects and holds personal information about entrants in order to administer the Competition and, where appropriate, award prizes.
  2. Entrants agree that the Promoter may, publish or cause to be published their name, photograph or likeness and locality in any media globally, without compensation.
  3. Entrants accept that personal information provided to the promoter in accordance with these competition Terms will be collected, held, used and disclosed according to the promoter’s privacy policy available at https://www.acu.edu.au/privacy.

GENERAL

  1. This Competition is run in Australia only.
  2. The Promoter reserves the right, at its sole discretion, to modify the Terms of the Competition at its sole discretion, including the prizes.
  3. If for any reason the conduct or operation of the Competition is not capable of proceeding as planned, is interfered with, or disrupted in any way, the Promoter reserves the right to cancel, terminate, suspend, modify or recommence the Competition.
  4. All decisions made by the Promoter regarding the Competition are final and the Promoter will not enter into any correspondence with you.
  5. If any provision of these Terms is held to be illegal, invalid, void or otherwise unenforceable, it will be severed from the remaining provisions, which will continue in full force and effect.
  6. The Competition is not open to:
    1. any employee, officer, servant, agent, supplier or contractor of the Promoter or the Promotor; or
    2. any natural or adopted child, or sibling of a person referred to in paragraph 38 a.
  7. These Terms are governed by the laws in force in the state of New South Wales.
