LEGL306 Marketing Law

Prerequisites LEGL101 Introduction to Law, MKTG100 Principles of Marketing
Teaching Organisation 3 hours per week (two hours of lectures and one hour of tutorial) for 12 weeks or equivalent in intensive mode or online.

Marketing Law introduces students to areas of law affecting the marketing and advertising of goods and services in Australian retail markets. Central to the concepts of marketing law are the legal rights owed to consumers. Consumers have various forms of protection which can be found in both the common law as well as under statute. Students will be introduced to the concept of consumer protection and how marketing laws in Australia aim to protect consumers from unfair selling practices. Statutory protections such as unconscionable conduct and misleading or deceptive conduct will be examined. In addition, the role of consumer protection and advertising agencies in the form of the Australian Competition and Consumer Commission, state government consumer agencies and the Australian Communications and Media Authority will be explored in enforcing consumer protection and marketing laws.
