The University has issued the 'Notice of Employee Representational Rights' (NERR) on Friday 11 August 2017 which provides formal notice to all staff that the University has commenced bargaining for a new Enterprise Agreement (EA).
While the ACU Staff Enterprise Agreement 2013-2017 has reached its nominal expiry date it will continue in operation until it is replaced by the new certified agreement or is terminated in accordance with the Fair Work Act.
The new certified agreement will be a legally binding document and will come into effect 7 days after the Fair Work Commission approves the agreement. All staff proposed to be covered by the EA should read the NERR.
Enterprise Bargaining is the process of negotiation that takes place between ACU and staff appointed representatives to set (usually a period of 4 years) salaries and employment conditions of staff. It is proposed that the new agreement will cover the following staff: Academic Staff at Levels A to E and; Teachers and Tutor/instructors currently employed under the Educational Services (Post-Secondary Education) Award 2010 and, Professional Staff at Higher Education Worker Levels 1 to 10.
Current arrangements - Employment-related Policies being updated
During the life of the current ACU Staff Enterprise Agreement 2013-2017 employment related policies and procedures were progressively updated to reflect the arrangements in the agreement. If any discrepancy remains between an existing Policy/ document the ACU Staff Enterprise Agreement 2013-2017 prevails.
Transitional items still covered by the previous Agreement
It is important to understand that there are a small number of transitional arrangements included in the Australian Catholic University Staff Enterprise Agreement 2013 – 2017, and this means some items will still be covered by the previous 2010 – 2013 Agreement until a later date.
The previous 2010 - 2013 Agreement shall remain accessible to all staff for reference due to these transitional arrangements. These transitional arrangements include actions (dispute or disciplinary process) commenced under the previous Agreement.
